1. Introduction

These Terms and Conditions govern your use of the Exceptional Lightning website and your purchase of any products from us. By browsing this site or placing an order, you agree to these terms. If you do not agree with them, please do not use the site.

Please read them alongside our Shipping Policy, Return & Refund Policy, and Privacy Policy, which form part of these terms.

3. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order. By ordering, you confirm that you meet this requirement and that the payment method you use belongs to you or that you are authorized to use it.

4. Products and Product Information

We describe our products as accurately as we can, including materials, dimensions, bulb fittings, and wattage ratings. Even so, please note:

  • Product photographs are for illustration. Finishes and colors can appear different depending on your screen settings and the lighting in the room.
  • Bulbs shown in product images are not included unless the listing states otherwise.
  • Dimensions are approximate and small variations can occur, particularly in handmade or hand-finished items.
  • We may update, improve, or discontinue a product at any time.

All products are subject to availability. If an item becomes unavailable after you order it, we will contact you and offer a replacement, a revised delivery date, or a full refund.

5. Product Safety and Installation

Our products are electrical fittings intended for indoor domestic use unless a listing states otherwise. By purchasing from us you accept the following:

  • Hardwired fittings, including pendant lights, chandeliers, and wall sconces, should be installed by a qualified, licensed electrician.
  • Installation must comply with the National Electrical Code and any applicable state and local codes.
  • Never exceed the maximum wattage stated for a fitting, and use only the bulb type specified.
  • Do not install or use any item that arrives damaged. Contact us instead.
  • Unless a listing states an outdoor or damp-location rating, a fitting must not be installed in a bathroom, outdoors, or any other wet or damp location.

We are not responsible for injury, property damage, or product failure resulting from incorrect installation, unsuitable location, unauthorized modification, or use outside a product's stated ratings.

6. Prices and Payment

All prices are shown in US dollars and include no hidden charges. Applicable sales tax is calculated and displayed at checkout.

We may change prices at any time, but changes will not affect orders already accepted. If a product is listed at an obviously incorrect price due to a typographical or system error, we are not obliged to fulfill the order at that price. We will contact you, and you may confirm the order at the correct price or cancel it for a full refund.

Payment is taken at checkout through our payment providers. We do not store your full card details.

7. Orders and Acceptance

Your order is an offer to buy. Our acknowledgment email confirms we have received it, but a contract is formed only when we confirm the order has shipped.

We may decline or cancel an order where:

  • The item is out of stock
  • We identify a pricing or product description error
  • We are unable to obtain authorization for your payment
  • We suspect fraudulent or unauthorized activity
  • The delivery address falls outside the areas we serve

If we cancel an order you have already paid for, you receive a full refund.

8. Shipping

We ship within the United States only. Delivery times, handling times, and carrier information are set out in our Shipping Policy. Delivery estimates are estimates, not guarantees.

9. Cancellations, Returns, and Refunds

Orders can be canceled before 3:00 PM Eastern Time on the day they are placed. After that, or once an order has shipped, cancellation is no longer possible and the order must be handled through our Return & Refund Policy.

You may request a return within 30 days of delivery, subject to the conditions in that policy.

10. Your Account

If you create an account, you are responsible for keeping your login details confidential and for all activity that takes place under your account. Tell us promptly if you believe your account has been used without your permission. We may suspend or close an account that is being used in breach of these terms.

11. Acceptable Use

You agree not to use this site to:

  • Break any law or regulation
  • Infringe our intellectual property or that of anyone else
  • Submit false, misleading, or fraudulent information
  • Introduce malware, or attempt to gain unauthorized access to the site or its systems
  • Scrape, copy, or harvest site content or customer data by automated means
  • Harass, abuse, or threaten our staff or other customers

We may restrict or refuse access to anyone who breaches this section.

12. Intellectual Property

The content on this site, including text, product descriptions, photographs, graphics, and layout, belongs to Exceptional Lightning or is used with permission. You may not copy, republish, or use it commercially without our written consent.

Third-party names and trademarks, including carrier names, are the property of their respective owners and are used only to describe our services.

13. Reviews and Customer Content

If you submit a review, photograph, or comment, you grant us a non-exclusive, royalty-free license to display and use it in connection with our business. You confirm the content is your own, is accurate, and does not infringe anyone else's rights. We may remove content that is unlawful, offensive, or misleading.

14. Third-Party Links

Our site may link to third-party websites. We do not control them and are not responsible for their content, products, or privacy practices.

15. Warranties and Disclaimers

We warrant that products will be free from material defects at the time of delivery and will match their description. If an item arrives damaged, defective, or incorrect, our Return & Refund Policy applies.

Beyond that, and to the fullest extent permitted by law, the site and its content are provided as they are, without further warranties of any kind. We do not warrant that the site will be uninterrupted or error-free.

Some states do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

16. Limitation of Liability

To the fullest extent permitted by law, our total liability arising from any order is limited to the amount you paid for the products concerned.

We are not liable for indirect or consequential losses, including lost profits, lost data, or loss of use, or for delays caused by events beyond our reasonable control. You agree to indemnify Exceptional Lightning against claims, losses, and reasonable legal costs arising from your breach of these terms or your misuse of the site or our products.

19. Changes to These Terms

We may update these terms from time to time. The version published on this page at the time you place an order is the version that applies to that order.

20. Governing Law

These terms are governed by the laws of the State of New Jersey and the applicable federal laws of the United States. Any dispute will be handled by the state or federal courts located in New Jersey.

Nothing in these terms affects your rights under federal or state consumer protection laws.

21. Severability and Entire Agreement

If any part of these terms is found to be unenforceable, the remaining provisions stay in force. Together with our Shipping Policy, Return & Refund Policy, and Privacy Policy, these terms form the entire agreement between you and Exceptional Lightning.
